I don't want divorce my wife wants it

04-Jul-2023 (In Divorce Law)
Hello Experts, I was married (court marriage) which was an Hindu marriage, ours was 2nd marriage & inter-caste. Things were going well for about a month an my mother suddenly got too ill (as she is diabetic), so having a 12 hour job I can't stay at home and work at home and take care of my mother, so my wife and my father (he is also too old) were only to take care of her, so the day came when my mother asked my wife to cook, but she couldn't. she asked her to help her (my mother), but again my wife kept on giving excuses & she did damaged some utensils and these things kept on repeating day after day, I just ignored all 6 months went, & suddenly she quarrelled with my mother & then i couldn't remain calm and i slapped her, she called her brother and went her home. Now she wants divorce, and i don't, i tried to explain her family that it was a mistake but they want divorce. What should i do? If she forces divorce then do i need to pay alimony? I have too many loans on my head. Pls help

Dear queriest, as per your query you have mentioned that due to some quarrels you wife has left the matrimonial home and now she is jnsisiting for divorce for the same reasons, and you are not willing to, here I would suggest that if she is not willing to come then you have to make an effort first by yourself then if it fails then need to send a legal notice for restitution, for more information in detail kindly call me

As per your query

since your wife has left the matrimonial house and you want her to return you can file petition for restitution of conjugal rights and ask your wife to come and decide with you. if your wife files a petition for divorce you can very well defined it by filing your say. With respect to the part of alimony she can wave her rights of alimony if you you put a precondition for divorce.

First of all their is no cruelty from your side. If she had not performed her moral duties then she has no right to ask divorce. Even if she files fake case on grounds of cruelty she can't prove. Issue her notice for restitution of conjugal rights.
