I am with marriage registry under spa 1954 whereas we both are Hindu.

In the year 02/2012 marriage was registard under spa act 1954.my wife with 06 years old daughter live
with his father since 2015 separate from my custody.Between 2015to 03/2020 wife don't agree to come with my ancestral resident property where I live with my step-mother with her step-brother family. My financial health is not so good. Last of all two big legal issue arise firstly-partition of my property,where my personal share how safe if I move for mutual contested divorse?
If both husband and wife agreed for divorce then file a joint petition for divorce by mutual consent . And minimum one year separation is required for filing mutual consent divorce petition.
In mutual consent divorce two important things are child custody and alimony matter , every thing is fixed by both parties free consent.
but without detail discussion proper consult is not possible.

hi, in your case your portion of share money is endowed with you but not with your step mother and other family, so you are gonna get that surely and on the other hand if you are divorcing your with she can claim the property or money as she think fit and proper but here you have to think how can you make her happy, if you can make her hapoy by givbing her cash then your property is safe...think of it and if feel need help can contact me.
