I am facing child custody issue and need divorce
25-Apr-2023 (In Divorce Law)
I have a 3 year old girl child. I want divorce from husband as he is mentally torturing me. He is not ready to give divorce because of child. What should I do in this case?
You can file a petition for divorce under cruelty without your husband and u take custody of the child since she is a girl child and also below 7 years so by default u will get the custody with u and also you can claim maintenance from yohr husband for yourself and for your child

If your husband is not ready to give divorce then you have to file petition for contested divorce in court on the ground of cruelty and any other ground if available for divorce, court may grant you divorce if you prove the said ground of divorce by giving evidence to court.
