you can file divorce and get x party order. court will issue 3 notice to your father and definitely he will never come after 3 notice court will allow divorce. once you get order make sure to collect the decree. and then enjoy your life as you can. second for your knowledge If the husband and wife live separately, the court will allow you to get a divorce .

Madam, I understand the pain and hardship you’ve faced due to your husband’s abandonment and defamatory conduct. Legally, you have strong grounds to proceed with divorce under desertion and mental cruelty as per Section 13(1)(ia) and (ib) of the Hindu Marriage Act. If he has not responded to court summons or appeared despite due notice, you can move an application for ex parte proceedings. The court, after verifying the facts and evidence, can pass an ex parte divorce decree in your favor. You may also be entitled to claim maintenance or alimony, depending on your circumstances. first you decide to stand what you want. you go with mother or father. if you go with mother then proceed divorce. bcoz you have not any other remedy since he come or you knew the address of him..but if you knew the address of your father then file a maintenance case or domestic violence act case.
