Husband wants to take divorce and not ready to bring me home

My husbands says no to bring me back to matrimonial home infront of judge.but i want to settle down..what if my husband wont ready...can he take divorce without my yes...

well madam you have to contact at my chamber for your legal question as per yourqyour query you are legally weded wife hence you have all right as per Hindu law moreover u have a legal question of divorce that can be done with out your consent....

Your question is not clear. Who has filed for divorce and on what grounds?
What is the stage of the case?
If you do not want divorce then defend and fight strongly to get the same dismissed. You should have filed RCR .you can file now and also maintenance case.

Under section 13 of the Hindu Marriage Act 1955, either husband or the wife can seek divorce on the grounds enumerated in this section and not other wise. These grounds may be " cruelty, extra marital affair, either husband or wife suffering from Psychopathic diseases,leprosy or any other contagious disease in a communicable form, venereal diseases etc. However you have not mentioned in your query as to on what ground your husband has sought divorce from you. Merely saying before the judge that he is not willing to keep you, would not entitle him for divorce. However you may take my assistance if you so desire.

He can definitely file for divorce under the Hindu Marriage Act on various grounds as provided under the Hindu Marriage Act , 1955. Section 13 under the act gives various ground on which the marriage can be dissolved by a decree of divorce, But that shall be a contested case and you can very well defend it and the court may grant a decree in your favour by not granting divorce.
