Husband wants divorce bcz of cruelty from wife, but wife doesnt

18-Jul-2023 (In Divorce Law)
Hi, I got married last year. From the day one of my marriage my wife used to fight with me as we have very less understanding between us. Gradually my wife have started doubting & blaming on me about my extra-marital affairs. she always tried to humiliated me, my parents and our reputation in society. In last one yr she has troubled me and my parents a lot.She is been swearing on me and my parents. Also asking me not to give monetary help to my parents and help her parents instead.I have decided to not to bring her back into my life as we are never going to live a happy life together. So from last 1 months she is living at her parents home. i am willing to go for divorce, she refuses for the same and she asked me to take her back at my home. Not sure if she wants alimony or doesn't want to file a case to court; Please help me with best option available for divorce without paying alimony as she used to earn good handsome salary before our marriage as confirmed by her. You can file contested divorce case against her after one year of marriage in family court withall your allegations and contentions , it will go for counseling thereafter. If she gets ready for divorce it can be converted into mutual divorce, if not you will have to prove cruelty and her financial capacity.

Respected sir.

If you wish to get divorce from your wife then 1st you have to send notice to her for giving consent for mutual divorce, if she does not reply or ready for divorce then you have to file contested divorce on cruelty ground

hi

in this case you can proceed to file divorce petition on the ground of cruelty and adultery.
as she is qualified and earning, she will not get alimony as per various decisions of higher courts.

verbally abusing your parents also amounts to mental cruelty so there is a good chance of you getting divorce peacefully
