We are going through marital dispute. Husband is asking for mutual divorce. He has kept every information regarding finances away from me. Now he is deliberarely putting unfavourable divorce terms to which I cannot agree. He has made home environment extremely hostile and humiliating me by witholding finances. We have 10 year old son and husband is forcing me to leave the house and threateninh that as he has money and providing education and shelter to son, he will get his custody. What to do

Madam, Please do not sign any mutual divorce settlement unless you are fully satisfied with all the terms. Mutual consent divorce can only proceed with your free and voluntary consent. If the husband is pressurising you, withholding finances, or creating a hostile environment, you have legal remedies available. You cannot be forcibly evicted from the shared matrimonial home without due process of law. You may seek residence rights, maintenance for yourself and your child, and appropriate protection orders before the competent court. Further, custody of a child is not decided merely on the basis of who earns more money. The court always considers the welfare and best interests of the child. The husband's financial strength alone does not guarantee custody. Consult a family law advocate immediately and preserve all evidence relating to threats, financial control, and harassment. Do not take any step under pressure.

You are not legally bound to accept a Mutual Consent Divorce on terms that are unfair or imposed upon you. Do not sign any settlement unless you fully understand and voluntarily agree to all financial, maintenance, child custody and property-related terms. Merely because your husband has greater financial resources does not automatically entitle him to custody of your 10-year-old son. Courts decide custody based on the welfare and best interests of the child, not solely on income. Further, you cannot ordinarily be forced to leave the shared matrimonial household without due process of law. If there is financial abuse, intimidation or coercion, you may seek appropriate legal remedies including residence rights, maintenance and other reliefs available under law. Before signing any divorce settlement, obtain independent legal advice and ensure complete disclosure of financial particulars and assets.
