Husband left us and staying in different house can I claim maintenance

Its being now twenty years of my marriage our marriage is intercast he's hindu and am christian my husband is in delhi police since my marriage he was residing wt me in my maternal house as he belongs frm south india last year he left the house and started living in a rented house without leting me know, me and my 18 years old son living wt my widow mother.my husband is not giving any money for me and for my son for survival since last 1 year ,now i need maintenance or componsation frm him as now am facing lot of problems to fulfill our requirements.kindly suggest me wt should i do

Yes you can claim all the rights against your husband as you are legally wedded wife of your husband. He is bound yo pay you maintainance and other benefits grnated by the law of land. Your son is also entitle to claim maintainance

You are entitle for maintenance . Your husband is legally bound to maintain you as per your standard. Maintenance comes under Criminal Procedure Code, so the intercaste or inter religion marriages will not affect your claim of maintenance. Revert me.All the best.

You should approach the court and file an application for maintenance. If you want to, you can also file a petition for divorce on the grounds of desertion by your husband. Under the law, you are entitled to maintenance from your husband.

you have remedy to get maintenance from your husband and he has to maintain you and your son. You have to file a petition under Section 125 Cr.P.C to seek maintenance. The court will decide on his income and your financial independence etc., but normally he has to pay atleat 1/3rd of his income as maintenance to you if you are unemployed. so better consult a lawyer and file a maintenance petition in the concerned family court.
