Hello, with reference to your question, you are advised to file a case of Restitution of Conjugal Rights in which you can request the court to order your husband to start residing with you or order the husband to make you stay with your husband

If the behaviour of your husband is intolerable towards you then rather dragging your relationship it’s better to file for divorce against her on cruelty grounds. I would suggest you for mutual divorce as it is less money consuming and ends up in maximum of six months. For more legal assistance I am just a call away.

The remedy you are looking for is called restitution of conjugal rights. You need to file a petition under Sec. 9 Hindu Marriage Act in the family court of your local jurisdiction to notice your husband to come and reply as to why he is not taking you back. As you also mentioned that you are unemployed which makes you eligible for seeking maintenance from your husband as well. For detailed conversation you may consult me.

Hello Mam, As your husband is the guilty party, he cannot seek divorce on this ground. If you want to stay with him, court will not grant divorce. And you can also file petition for maintenance and get a decree from court. If your husband is not allowing you to live in his house, you can file for restitution of conjugal rights.
