Husband gave two talaaq and not giving maintenance for our son and me

Muslim. Married in 2018. I went to Saudi in feb 2019. He works in a govt. Company in Saudi .He harassed me physically, mentally and slowly cut me from my family by restricting phone calls, didn't allow my uncle who also lives in Saudi to meet me..Also never allowed me to go out alone. Then he made a mistake in my visit visa and so I have to reside there till march 2020. He tortured me throughout. He ask my gynaecologist to make fake reports to show to Saudi govt. For my visa issue. I supported him because he might have lost his job.Our son born in Saudi. And we came back to India in March 2020.He took my phone and break it. Gave two talaaqs one in Saudi and second in India. I came to my parents house in mid july 2021. From then he didn't gave a single penny for us. Send 10000 for my phone and 10000 in april 2021. What should I do to ask for maintenance even after I tried he is uninterested and don't talk to my family.? What about our son's custody because I want to have his custody?

Bare perusal of your query makes it clear that it is a case of domestic violence and non maintenance of the spouse. You can file a complaint under section 12 of the domestic violence act, further for maintenance a petition under section 125 crpc should be filed. For child custody further and better details are required.

You should file a complaint of domestic violence in the concerned police station against your cruel husband. Also He is liable to maintain you being the husband. You can proceed to court to file for maintenance case. Also in order to get the custody of the child, you can also approach the court to grant you the same. You can initiate criminal action against your husband and as far as the custody of your child is concerned you can move an application in the concerned family court seeking the custody of your child what about the atrocities has been done on you by your husband you can file a written criminal complaint in the concerned police station and I assure you action must be taken against him for more detail please share your query in detail thank you

You need to file case under section 125 CrPC or Domestic Violence case. You must first try to include his n your family members n relatives to resolve the issue n if that doesn’t work out the. U can knock the door of court …yes u will hv child custody bcoz of age group
