Husband filed false 420 case against me. What should I do ?

Hello there, my husband has filed a Complaint Case under Section 420 IPC against me and my family. Though, I and my family have never cheated him but he still filed it in and with his father he has recorded statement against me. Now, the 3rd evidence, which was A Police man, he didn't appreared in the hon'ble court for the evidence, hence, case Disposed.Dismissed In Defalut For Want Of Prosecution. I have got all the documents in my support that I have never cheated on him, be it financially or emotionally. I have filed a case under Domestic Violence so, in the revenge he filled 420IPC against me and my family, though, I have NOT filled any case against his family but he has done against mine. What steps can I take now? As, 420IPC is dimissed now. Thank you, Much Regards, Religion- HINDU

If you have filed domestic violence case then you have to fight and if he has filed case u/s 420 and case has dissmissed . you can file defamation case against him . or if you wanna take divorce so you can also file divorce case.

What action u wanna take against him. You have already file domestice violence. Now u van file for maintainance case against him. You can also file a case for false representation before the court for false casw

You have yourself answered. See when case is dismissed non prosecution then nothing survives and there is no finding given by the court on merit against you. You may file quashing of FIR in high court if so advised.

First of all as you say the case has been dismissed for non-prosecution you have nothing much to worry. But before saying anything any advocate would want to see the contents and allegations in the complaint. Now they may move an appeal before the High Court. Under such circumstances you can approach High court on your own to quash the FIR and complaint against you.

Case can be revived by filing an application. So you have to take some strict action against him to transfer the pressure. If the case revived you can file a quashing petition before high court. You can also claim maintenance from your husband if he is not paying you now. Revert me and tell me what kind of cheating he has alleged. All the best.
