Husband deserted me and asking me to to live in his hometown

26-Sep-2023 (In Divorce Law)
Sir/Madam, I have been married for 4 months and we lived together only for 15 days. My husband is from lower middle class family and we are from upper middle class, we didn’t mind the class difference as we thought if we give him a push he might excel in his life. My parents got him a job with 40k salary, dresses and everything a person needs. We were living peacefully but his mom and dad were not happy leaving his son from their native and they created many problems. His mom created a scene and we had a fight one day, next day he deserted me and went hiding for 13 days. We filed a missed person case and after 13 days he came with his lawyer and closed the case. Now they are demanding me to live with him in his native or get divorce. I dont want to live with him with the fear of leaving me alone again. My parents have spent lot of money in relocating us to new home bought him a bike. He took the bike and left. Kindly advise in this regard, what should be done.

Where he has left you alone or with your parents ? Have you made a house in Bangalore ? If he was given a job of salary as you said, has he left the job too ? You can refuse to go to his place, But you need to approach the Court first. Matter of divorce will not come so soon.

If you don't want to stay with him you can go a head and file for divorce on ground of cruelty asking for divorce .... And also claim maintanance from him .... If you would want to stay with him you can also file restitution of conjugal rights asking him to rejoin you and make a separate house as his parents are interfering in your life's ... Kindly decide on these two factors and you can take decision as how you want to proceed further

Hi, Just 4 months back only both you have married better you have to go to the court and put the petition Under Hindu Marriage Act. Restitution of Conjugal Rights - (Right to stay together) If either the husband or the wife, without reasonable excuses, withdraws from the society of the other, the aggrieved party may approach the Court for restitution of conjugal rights. and court will send both of you to Mediation or Council ling.
