husband after filing divorce ask for conjugal rights by IA or notice

I have filed divorce case directly without legal notice.wife neither giving divorce not ready to live together.she asked for order 18 under D V act. I am ready to live together or for divorce.wife is not responding blocked contact calling. what should i do. 1.can i ask for written statement whether wife willing to come or divorce through I A 2.can I ask court wife not ready to give conjugal rights or for divorce so can i gobfor 2nd marriage. 3.can i file both for rcr or divorce at the same time.4.should i go for d v. what should i do

Dear Sir, There are circulars that divorce case to be diposed within 12 months if not approch High Court for direction to the family court. You cannot ask both alternative reliefs. Just ask for divorce if she is interested she will come otherwise divorce decree will be passed. Please give me Rabk 5.

no you cannot file rcr and divorce at the same time. the section 18 under dv act is her right, u can ask for mediation from the court sit down and ask for a settlement. if this doesn't work then u can proceed and move to evidence stage

you issue a notice to your wife now saying that a case for divorce filed by you is pending, and dv act filed by her is pending too. that she has filed an ia under order 18 which is pending disposal. That you are ready to forget everything in the past and ready to live with her. and that if she is also really ready. Give her 15 days time to comply. if she is not coming you have evidence before the court that even though she is not willing to live, she is only filing false cases on you. if you can let me know the full case. then we can give you some solution
