How to prove cruelty and discretion by wife to get Divorce

Hi i am 38 yr old married from 10 yrs with no child from this wedlock.How I can proof cruelty and disertion by wife. Mine parents are quiet due society issue and I got fed up in all these from her in last 10 yrs. Due all such tension faced 2 accidents and tried to commit suicide too. She neither want to give divorce mutually nor she living calmly. She live d way she want in self ego and doubtful nature. Not adjusting like a family member in such long period and not understanding of any. I m unable to live mine socialise life due her doubts on each and every one either friends colleagues or neighbourhood . Is any way I can prove what is her actual face to get solution from this marriage as I m only getting warns from her and her parents for legal or keep continue quitely

u can first see what is wrong and all why is she doing all that what is the basic promblem with the family and all is.she.not happy after marriage and all u canafter all tell her or ask her what is the promblem or file for.a divorce

For true advice you have to share your whole story from the beginning of marriage to till today in details. Details you are providing is not sufficient to prove cruelty. You are also asking about discretion which means your own choice. Hope it is desertion and not discretion, in that case you can not prove this as your wife is living with you, with few exceptions.

If you are sure that divorce is the only remedy you may file a divorce petition immediately seeking divorce on grounds of cruelty. You will basically have to show categorical ways in which she has committed cruelty viz. misbehaviour with you and your parents, refusal to bear children, obnoxious habits, etc. However, if she is not working or earns way less than you she might claim maintenance from you, if she earns well then maintenance wont be an issue. I advise that you file the divorce petition before she can file any kind of legal proceedings against you.
