How to marry without getting a divorce?

My husband and I separated 11 years ago due to his behavior/actions - alcoholism, gambling, stealing, not working etc. I met a man around 7 years ago and he wants to marry me. I am a Hindu and have a 10 year old daughter staying with me. Can I marry without getting divorced? He won't agree to a divorce. I got married in 1998.
Marriage with you getting the divorce will be illegal. You can file the divorce case individually. But before that explore if you have any chance of mutual divorce, because that is less time consuming and you have been living sepret since long time.

As per hindu law you can't do second marriage if your husband is live so first of all you have to get divorce then you can do second marriage. You can file divorce case against your husband on the basis of your above mention reason.

you may file an app. of 13 A of HMA and get divorce on the basis of 11 year sep. and other grounds . if you get married in future without divorce you may be procecuted u/s 494 of IPC if your husband make a complaint.
