How to get maintenance in 3 years old case

27-Jul-2023 (In Divorce Law)
I have been married for 5years now and fighting for my rights for the last 3 yrs. but court is not supporting me in any manner. I am unwell lady. Suffering with dangerous diseases as well. My husband came in court after 3yrs in divorce case. Now he is saying that he is unemployed which is 100% lie.. His intention not to pay single penny but I need money for my medicine and basic needs. I have changed 3 lawyers so far but none of them was capable to win my case. They all were liars , gold diggers. Not even a single genuine lawyer I think is there. They all were sales man I think not lawyers. Law , justice become money game . No one understands pain of others. My I’d is [email protected]

Rather than doing a divorce case against your husband I would suggest going for filing of a petition under section 125 CrPC. That will be a criminal case and your husband is duty bound to give maintenance to you. And if you have got proof of his employment then attach it to the petition. For more legal assistance I am just a call away.

First of all while litigations are pending you need to have patience. Lawyer can represent you but cant guarantee the outcome. It depends upon certain factors like merits of the case, Judges discretion, parties behavior and intent etc etc. So far as your maintenance is concerned your husband is duty bound to maintain even if he is unemployed. Courts in various judgements have held that husband is duty bound to mainten even if he has to beg borrow or steal. Further you may seek detailed consultation

Good Evening Ma’am, I hope you are doing well. Regarding your query, Ma’am you should get maintenance as you are sick and even you are living apart from you husband. This is the basic right of yours. Which no one can deny. Warm Regards, Adv. Rohit Singh

Have you filed any DV case against your spouse? You are definitely entitled for maintenance but proper consultation and guidance can only be provided if you give proper details regarding your case. Please contact.
