How to get file quash or clearance of the pending case of 498a,323,506

01-Sep-2025 (In Divorce Law)
My brother’s wife has filed a false case against me and my husband. The case was filed in 2022 and is currently pending before the Gudivada court at the trial stage. All the allegations are false, and we are not even living under the same roof. I want to know the legal options available to come out of these cases.

Since you and your husband are not leaving your brother's wife's ,highlight this fact to prove no domestic relationship . You can file for discharge at the time of your trial , or approach the High Court under Section 482 CrPC for quashing false charges. so keep evidence of separate residence and consider action for false defamation.

Since you and your husband were not living with your brother’s wife, you should: File a Discharge Petition before the trial court if no evidence exists. Or, approach the High Court under Sec. 482 CrPC to quash the false case. Defend strongly during trial if case continues—most such false cases fail. after succeeding you can file defamation against your brother's wife

If the case is false, you can approach the High Court under Sec. 482 CrPC to quash the FIR/case, especially if you have proof of living separately and no involvement. If the trial has already started, you may file a discharge petition in the trial court before charges are framed. During trial, collect strong evidence—documents, witnesses—to prove your innocence. After acquittal, you can proceed against her for defamation or malicious prosecution. Immediate relief is best through quashing, which requires proper drafting and evidence.
