How to get divorce if the husband is not showing up for hearing

Sir I filed divorce petition against husband.from court they send summons to him but for that no response from his side.nextly court decided to give look out notice and court gave date in this month..my question is that if he didn't present on court fixed date.. How should I get divorce?

When a petition for divorce is filed by you, the court had issued notice to him. But even after receipt of notice, he is not turning up towards the court and if not becoming present even after giving 1 or 2 chances, the case will be set ex parte. ie, you will be given a judgment of divorce without hearing him; which later will become a decree of divorce.

You will get the exparte decree from the court if your husband is not appeared in the court even after the affixture and paper publication. So on the next hearing date you can file the affidavit and you will be allowed the divorce.
