How to get a case filed by wife for alimony transferred to hometown
10-Aug-2023 (In Divorce Law)
I m working in a foreign country, my wife stays in India with her sister and my child. She always fight with me and we are seperated more than a year. She is earning 47 thousand and her sister 30 thousand per month. She filed a case against me to give 1 lakhs per month and my mother died in March due to the tension is given by her, my father is very ill. She filed the case in the city she lives in. Please suggest how to get the case transferred to my hometown.
In order to transfer the cases in your hometown, you need to approach Hon'ble Supreme Court of India with transfer application in the event the case needs to be transferred from one state to another. IN the event the case needs to be transferred from one district to another, but within one state, then you need to approach high court of the concerned state, which has jurisdiction over the said districts. IN the event you require more specific answer you may contact me with more details of your case.

first and foremost , the case cannot be transferred to your hometown, only chances to get the case transferred is that you are ready to pay the travelling allowance to her for each and every date. if not forget that the case will be transferred. and since you have mentioned you work in a foreign country the case would not be transferred in your home town.
second part where she has asked to give you rupee 1 lakh is considered you are suggested to defnd the case through a lawyer and prove she is earning 47K per moth and you will get relief .
as concerned about your mother and father your lawyer will guide you how to deal with that as those things cannot be discussed here.

sister's earning has no concern with your matter, she surely can claim maintenance from you, as you say child is living with her, therefore, she can claim maintenance through child also.
however, maintenance allowance depends on many factors such as earning capacity of both (husband and wife), social/financial status od both (husband and wife), expenses of both, liabilities/assets of both etc.
she can file the case in the city she lives in and you have to appear and defend the same right there.
