It is not mandatory for your husband to agree to give you divorce you can directly file a case in court stating that you are not happy with the marriage and family and you are willing to get separation from them

Madam,

First of all, have talks with your husband about mutual consent divorce and if he consents for the same, both file mutual consent divorce petition. Divorce will be granted by the court after 6 months. However, if your husband is not ready for mutual consent divorce, you have to file petition for divorce from your side only and seek to get divorce. Your husband might contest the case but you have to prove the facts stated in your divorce petition and win the case to get divorce.
