how to file for divorce and time to be taken

My daughter got married on 18.06.2017. Son in law is chronic wine drinker. He doesn't return home after office hours. He returns next day at 4or 5 am. Then sleeps and bunks his office. This happens on alternate days and on holidays. My daughter is working in a nationalised bank and he works in local government authority as officer. My daughter has returned to my place. We are Hindu and the marriage is not yet registered under the act. How can she get a divorce in minimum period of time? As of now she is mentally disturbed and we have consulted a Hypnotherapist. We don't want her to suffer more.

She needs to file divorce petition in the court. In case her husband harrses her she can file police complaint simultenoisly she can file application under Domestic Violence Act for protection.

Although having marriage registered is a strong proof to possess about marriage but there are special provisions in law specifically section 8 (5) of Hindu marriage act that also makes marriages without registration as valid provided there is enough proof that can show the marriage was solemnised as per Hindu rituals. We can discuss more about divorce but generally there has to be 1 year completed for marriage before we can apply for divorce unless there are some extreme problems that will need divorce to ordered early. If your son-In-law is also willing for divorce then you may go for divorce with mutual consent which takes minimum time of 6 months.
