How to file a case under section 13

Sir/madam i am from hindu religion and have filed section 9 against my wife in April 17 i got favor decree in december 17 as she didnot attend any hearing in court. Now i am planning to go for section 13 of divorce. How section 9 will help me in this case and what will happened if again she do not attain any hearing,will i get one side decision and can she ask me for maintenance if attain hearing.

Hello client .I have received ur query as u have filled cases of section 9 hma in this matter u want the ex parte divorce in tht matter you have take proper steps to get the ex parte order of divorce in this matter u have to take help of Advocate

Sir no use for filing the section 13 divorce . Talk to your father in law regarding this see what he says . Then go for that action if they say for the money part then go for one time alimony and mutual divorce . But if they too do not respond then it is the best to go for the ex parte divorce and keep the decree with you . And after that avoid all the court case or any summon you get from the court and change your contact details so they or wife can not contact you .

If your wife is not attending hearings this means she is not interested whether you get the divorce decree or not. If she is just not attending any hearings then this might help you, as she wont come to claim maintenance once an ex-parte divorce is granted to you. However, after getting the divorce you shall have to wait for 30 days, as she has a right to file an appeal challenging the ex-parte divorce decree. In case, she does not file an appeal challenging the same, you will be at a liberty to start your life again or marry again.

As you told that you already get a favorable order in your section 9,
This will give you great help in your section 13 matter in your evidence part.
Also you asked about that if she ll not attend this hearing also than that will be the best part as you will get ex party and will get a decree in your favour.
And yes she can ask maintainance if she attain hearing.
