How long I need wait to get child custody?

It's been four years of marriage and we have baby boy 2.6 years old, recently I got some argument with her father and due to that my wife left my house on her own, saying she'll not come back and she has put her phone off.
My wife is a house wife, my father in law is greedy person, he has been asking for money from me since marriage time, and initially I refused to give any finical support since then he has used bad words. And then I stopped going to my in-laws place
Now there is no way for me to talk to her family members, and my wife says, she'll what her father decide
Request you please help me to understand below point.
How long I need to wait for her return?
If she ihas not returned for some time, is there anything I can file in police station or court?
How long I need wait to get child custody?
Is there anything I can do get the child custody?

You can file case for restitution of conjugal rights and may also file case under guardianship ward act for your child custody if your child is above 5 years. Filing case is the only legal way to get the things right.

you should send a legal notice through a lawyer to your wife without any further delay for restitution of conjugal rights. if she still adamant to live with her parents then you should file a petition for restitution of conjugal right under Section 9 of hindu marriage act. if you need any further information or clarification then please contact me
