How can mutual divorce from second marriage be taken under muslim law
06-Jun-2023 (In Divorce Law)
Dear Sir Due to some situation & quarrel at my house, my wife went to her home and was staying there. I tried to bring her many times, but she refused. After waiting for 5 years, I got married to another lady who was divorced from another relation. When my first wife came to know about this, she filed a case against me & my mother and returned to my house. She is not ready to accept my second wife and my second wife now lives in her house. Now myself and my second wife wish to divorce. I would like to know the procedures for the same. There are no children in my second marriage. We are from muslim community, and the marriage not registered with any local bodies. Only nikah ceremony done from a masjid near to her home. For the purpose of nikah, no letter had been issued from the masjid in my area. Expecting your soon reply on this regard Thanking you Yours faithfully TA Shyhas
Hallo.....If both of you are looking for the mutual divorce you can easily get it from the Masjid. So both you and wife should prepare an agreement with the assistance of a lawyer that the wife will not be able to go for any court under the privilege of Muslim lady.
You have the option of divorce through pronouncing talaq following the due process... .
