How can I sue or file a case against my Dad

23-Aug-2023 (In Divorce Law)
My dad went to Canada in 1997 since then he always said he was working for us to bring Canada. After almost like 10 years we found out that he already married to someone else he told us too since we found out it is more 10 years already. Since we were young our mother decided to remain quiet and he promised that he will look after us moreover her. She was not rich and did not even know any law is also a reason Now she is suffering from a disease and he says he can’t help much. The disease needs a lot of money and he just sent some and said he cannot help anymore do what you want. We want to file a case against him and sue him He is a citizen of Canada now

Hello, I have perused your query. Second marriage, during the subsistence of the first marriage, is illegal in India and the relationship arising from the same does not have any validity. After 1955, with the help of the aforementioned provision and Section 11, Hindu Marriage Act, second marriages came be declared null and void ab initio. Your mother can file for divorce on the ground of bigamy and can seek maintenance for herself and her children in a family court of law in India. Your father cannot deny maintenance in regard to his children. For any further information feel free to reach out to us.
