Hindu Wife left home 4 months ago

23-Jan-2023 (In Divorce Law)
Me, my wife and my parents were living in the same house. My wife left my house 4 months to her maternal house and is not willing to return home. SHe demands that if I make a separate house, then only she will come and live with me and she is not willing to stay with my parents, neither wants to visit them if at all I take a new home to live with her. She has issues with my mother. She is also working and we both earn almost same salary. She has not supported anything to my family till now and no dowry was taken. Marriage was done from bride's side. She has also threatened that she will file complaint agianst my family on harassment. 1. What is the consequence if I take a new home and she puts false allegations later on? 2. IF she does not agree for mutual divorce, what are the possible options for me to clear this out sooner? 3. Can I file an NC complaint in the nearest police station and keep it for safety?

no don't do that and messup approaching here and there just proceed filing restitution seeking court direction to wife for returning to matrimonial home from her parental home and you can easily stand in safe position otherwise you may face severe consequences, proceed early before she proceed against you and your family and take the early decision.

Filing domestic violence and dowry harassment cases against husband and family even for silly quarrels has become a major problem, because of the ease of filling the complaint in any police station and some police officers are quite happy to register the case, because of the potential of extracting money by threatening to arrest you.
1. It's decision you have to make.
2. You can file a petition in family court asking for Restitution of conjugal rights ie an order from court asking her to live with you . Also you can file for contested divorce.
3. Yes, but get it done with consultation if a lawyer

1. It's a choice you have to decide and take.
