Can I go with hma12 instead of filing divorce s she has some lung disease before marriage

Yes...you can always file a petition under section 12 for the annulment of your marriage. And if there's no scope of living together then rather than stretching the relationship you should go with mutual divorce because it's cost effective and ends up in a maximum of six months. it would be a better option to go for voidable marriage options as under divorce section you will be a divorcee for life whereas under sec 12 your whole marriage would be null & void and you would be termed unmarried instead of divorcee

Dear sir Section 12 of Hindu Marriage Act does not provide for divorce or nullity based on the ground of a spouse having some kind of lung disease. I'm afraid you have been wrongly advised. However, you may consult me to find out the alternate grounds of divorce from your wife.

Yes if your husband is having any kind of disease prior to the marriage and you were not aware about that so you can file for the annulment of the marriage instead of the divorce. That could be better option for you
