Hi My wife left me post 4 months after Marriage and now its been 4 months we are staying away from each other. I am assuming that she and her family are wanting a Divorce and I don't want a Divorce. Will the Divorce be accepted does she have the right to go for a Divorce we have barely stayed or been with each other to take such a big decision. How can this be stopped or avoided.

First and forth most take a detailed legal consultation on your ongoing issue from an advocate. Your wife had left the matrimonial house 4 months back and thus a precautionary legal measure needs to be taken forth with. You have an option to file a petition directing her to comeback and resume co habitation.

hi if you want to give divorce then you could file petition for restitution of conjugal rights in court and if she is filing for divorce she has to wait to complete 1 year from the date of marriage and then you could decide about the futurw steps to be taken

1. If you do not want your marriage to end but rather want your wife to come back to your house you must file a case of restitution of conjugal rights under section 9 of the Hindu marriage act 2. after filing this case the court will see whether there is a valid reason for your wife to leave your home. 3. in case there is no valid reason the court will order that your wife should come back to your home. for further queries feel free to contact me

According to law the couples has to wait for 12 months before filing of their divorce. But in grave condition where's no scope of any cohabitation they can approach for mutual divorce under section 13B. But in your case you can always file a petition under section 9 HMA before she files. For more legal assistance I am just a call away.

You can file a petition under section 9 of the HMA Act and the court may grant you relief in the form of mediation between you and your wife. There at the time of the sec 9 petition, you can convince your wife to get along with you.

You can’t stop your wife filing a divorce case, that is her right but if you want court not to pass decree in her favour then you need to hire an expert advocate to fight back the case ! It’s better you hire an advocate now to do all your home work before she takes any step ! All the best
