Hi, my marriage is 1 year 2 month old. After my wife's positive pregnancy report she started behavin

Hi, my marriage is 1 year 2 month old. After my wife's positive pregnancy report she started behaving very opposite and went to her mother's place and gave birth to a baby boy. Since she reached her mother's place she planned to never come back and forcefully trying me to let her stay there with the baby and asking me to pay maintenance and visit her place on weekends. In this situation I'm planning to get seperated because I'm not able to keep my self stable. The baby is 4 month old and the marriage is 14 month old and she is not staying with us since last 9 months. There was no incident of violence between us but she and her family always tried to torchure us by giving threats of domestic violence, dowry etc. Please suggest me what can I do if I want to get separated and also if I want to take my son's custody who is 4 month old

you can file petition under sec 9 hindu merriage act for the come back your wife at home if you don't want that she is return home then you can file Divorce petition under sec 13 Hindu Merriage Act you can also file petition for child custody

it's a case of mental cruelty against you.....she left you and your family with her choice. you and your family did not force her .. if after many requests she is not willing to stay with you and family separation is only solution ,it's very early to say ...u keep trying to concialialte if possible bcos you have infant baby and at this point of time court will not allow you custody for a infant because he needs his mother at this point of time .it's general practice in India when parties are not willing to cohibit together they start threat and misusing of women laws ...so don't you worry about domestic violence and other criminal concocted and fabricated charges....if you both have realized there is no other solution except divorce.....for this you go legal....n consultant. further...
