Dear client, I have seen your query carefully and found that you want to know that how to serve the summon upon the wife in divorce case which is already filled by you in family court. In this regard it is to inform you that according to the provisions of the Civil Procedure Code the summon will be send by the registered post if summon not served and returned back with the endorsement that party is not residing at this address then you can file an application along with affidavit to this effect that your wife is residing on the address as mentioned in the petition but she is not receiving the summoning deliberately and intentionally with the collusion of the post man. So in this situation it is very much important and necessary to publish the summon in the newspaper. After the publication of summon in newspaper the court will presume the service of summon is sufficient and proceed the case exparty against your wife. Secondly you can also file an application for service of summon through the court where your wife has been filed a case against You and your family members in domestic violence act. you will have to attached a copy copy of dv case that address is correct and after that file an application in the court for gazette of summon in newspaper . the court will allow the application and take necessary action for that.
