Harassed by husband how can I file for divorce

My husband fights with me n threatens to harm me n kids. Lies around to everyone that I try to hurt my twins. Last day he tried to hurt me n kids with a weapon n layer tried to hurt himself with a knife. I need a divorce but don't want to lose custody of kids. How can I prove that he's guilty with these weapons. Is it possible to do fingerprint verification with out police case

Please take recording of his act to prove the guilt of him.you can file a case for divorce on the ground of cruelty .you must submit the proof gor the same slong with it.Give a complaint to womens commission. case too.contact me for detailed advice if needed by phone consulting.

Facts could be proved by oral evidence as well, provided you can stand by your version during cross examination and there are no substantial inconsistencies in your deposition. Once you can prove the facts as stated, the court will grant the custody of the children. However, everything depends upon the facts pleaded and proved. And it takes time for the Court to decide the dispute.

Stop worrying about the harassment and the cruelty of your husband.File a complaint to your nearest police station against him. If they are reluctant to take the case against him you can move to the JFCM court directly. And file a petition before the Family court for divorce on the ground of cruelty. You can file the petition for the custody of the children as well. Go ahead. Definitely you will get the justice.

You can file dowry arrosement case against you husband and also file domestic violence case against him. You can also file Divorce petition on ground of cruelty and mental, physical arrasement and you can also file maintance petition before the family court.

There are 3 parts to your question: Divorce, Maintenance and Protection. (A) If you want a divorce, you can file a Petition for Divorce against your husband, in which you can file an Interim Application for Maintenance, meaning in the initial stage itself you can seek maintenance for yourself while the Divorce Case is going on. (B) If you want only maintenance, you can file an Application under Section 125 of the Code of Criminal Procedure; (C) If you are suffering abuse and want protection from your husband, you can file a Criminal Complaint with the Police Station.

Don't take physical abuse, in case u r abused go to the doctor and get a certificate stating the facts to the doctor for some kind of evidence in the future. You can get maintenance if you are not working irrespective he agrees or not. Either you can file a petition for divorce and seek interim application for maintenance, else u can file maintenance case only if u dont want divorce.
