Guidance on filing a divorce case on adultery charges
26-Aug-2023 (In Divorce Law)
My nephew (25 Yrs) married on 14th June 2020 by Hindu religion. His wife has cheated him as she is having extra marital affairs. He got evidence (Photos & Videos, whatsapp chat) from her mobile on 8th Jan 2021. On same day we called her parents & sisters, sent her back with them. They didn't questioned her. We tried to contact them to file a divorce on mutual consent as we don't want such relation to continue. From her chat history, we learnt she is planning to get marry her lover. To conclude this case we tried through mediators, but they are delaying to harass us. We are in a confusion state for next step - Whether to file a adultery case or fraud case against her, lover & parents? What are the Pros and Cons? Please suggest. If we file an adultery case then whether we have to give an alimony? What if they counter file a dowry case?
okay I understood your questions do you have to file a case divorce groundes for cruality and Audaltry so you will proove the court to adultry ground you get devorce easily and you have to file a criminal case againest her boy friend also so you have to file these are all casess againest her
Dear Sir,
Immediately file a divorce case on the ground of clear and established adultery. You need not any alimony since she is leading adulterous life. If any dowry case is filed immediately approach High Court and get it stayed and quashed. She cannot claim any Maintenance. In the divorce case you may array her lover as second Respondent.
