Guidance Needed on Annulment Due to Concealment of Sexual Orientation

06-Jan-2026 (In Divorce Law)
My 22‑year‑old niece married in Oct 2025. Two months later she found WhatsApp evidence that her husband has been in multiple relationships with men and never wanted this marriage. He admitted he is bisexual but has only been with men. The marriage has not been consummated. Chats show he told his family about this in Jan 2024, but they hid it and proceeded with the marriage. This has caused severe emotional distress. We spent over ₹25 lakhs on the wedding.

Based on the facts you have shared, this is a clear and strong case of matrimonial fraud under Indian law. Your niece’s consent to marriage was obtained by deliberate suppression of material facts—namely, the husband’s prior same-sex relationships, his lack of intention to perform marital obligations, and the prior knowledge of his family, all of which directly vitiate consent. Since the marriage is recent, unconsummated, and the fraud has come to light only now, the law provides robust remedies including annulment of marriage, criminal action for cheating and mental cruelty, recovery of substantial wedding expenses, and compensation for emotional distress. Courts have consistently held that while sexual orientation is not illegal, deception and inducement to marry on false premises is actionable. With proper strategy and evidence preservation, this matter can be pursued firmly, quickly, and in a manner that protects her dignity while holding the husband and his family legally accountable

This is a strong case for annulment under Section 12(1)(c) of the Hindu Marriage Act due to fraud and concealment of material facts. The husband’s sexuality, prior same-sex relationships, lack of intent to consummate, and family’s suppression vitiate consent. Non-consummation and emotional distress also amount to mental cruelty, supporting divorce in the alternative.

On these facts, your niece has strong legal remedies. She can seek annulment of marriage under Section 12(1)(c) of the Hindu Marriage Act on the ground of fraud and concealment of material facts, as consent was obtained by suppressing the husband’s sexual orientation and unwillingness to consummate marriage. Non-consummation and prior relationships are relevant. She may alternatively seek divorce for cruelty. WhatsApp chats are valid electronic evidence. She can also claim return of streedhan and wedding expenses, and initiate criminal action for cheating and cruelty if advised. Prompt legal action is recommended.

On these facts, your niece has strong legal remedies. Since the marriage was not consummated, consent was obtained by fraud and suppression of material facts, and the husband never intended a normal marital relationship, she can seek annulment under Section 12(1)(c) & (a) of the Hindu Marriage Act (fraud + impotence/non-consummation). Concealment of his sexual orientation and prior conduct amounts to mental cruelty. She may alternatively file for divorce on cruelty. Criminal remedies like Section 417/420 IPC (cheating) can be examined if deception is proved. WhatsApp chats are valid electronic evidence. Recovery of wedding expenses can be claimed through civil suit for damages or settlement. Immediate legal notice and evidence preservation are advised.
