Got divorce by mutual consent on stamp paper want to get court decree

My daughter marriage arranged in Dec 2016.her divorce taken on 100 rupees stamp paper by mutual understanding.it is necessary or not to take court decree before remarriage.for court decree when we can apply.how many times we have to appear in court.we are jain religion

Dear from which religion coming from u is not important but stamp paper is only consider as document. And at many palces it is not legaly and acceptable. So for legal documents of divorce is only decree so as per my advice u must have to obtain court decree.

Divorce on stamp paper will have no legal validity and could create hinderance for your daughter in the future. Thus a court decree under mutuality clause can be sought for. You would have to approach the court for the same. You may contact me for the same

You have to file for divorce in the family court and obtain the divorce decree. If the divorce is with mutual consent than application under section 13(b) should be filed in the family court for obtaining divorce decree.

Yes it is necessary to get divorce decree before remarriage.


You can apply before the Hon'ble Family Court and get your concerned decree by applying with judgment given by court.

Yes sir u have to apply for court decree. Decree by notary is not valid. For decree by mutual consent you he to appear only twice once for filing and second at the time of decree.
