No you will have to file an anticipatory bail application before session court because it's non bailable offence police have power to arrest you directly but due to supreme court ruling they cant arrest you directly so hire any lawyer for anticipatory bail , once you get anticipatory bail then go to highcourt for quashing of FIR or file discharge before magistrate court
