Hi. Since your daughter is just 6 years old now, mother will have the custody of the girl child unless you prove that mother is not fit to take care if the child otherwise it is in the mothers to have custody of the minor children specifically girl child. Anyway, you can ask visiting rights and the court will really appreciate that and give orders on visiting rights to you

Dear Sir,
Under the provisions of Guardians and Wards Act you can apply for permanent child custody. Normally, it will be allowed since child has crossed five years of age. In the meanwhile you may file interim application for custody of the child. Thus, take the child to your immediate custody.

You can apply for custody but it depends on various factors such as (1) are your wife and you divorced or only separated?(2) are you allowed to meet your daughter? (3) why do you want custody? We need all these discussions
