How can father get his 17months baby his own custody after his wife went to father house?

father can get custody of child only on 2 grounds otherwise it is very difficult for a father to get custody of child and for that you have prove those 2 grounds in a detailed fashion so that you win the case just by filing a case a father will loose until properly planned

You need to file a case for restitution and custody against your wife... if she agreed to come back to your house then all right otherwise you may give her mutual Divorce and take the custody of your child.

you can only get the order from the district judge to visit, that is called right to visit, and you can go to see your baby as the baby is only 17 months, you cannot file any custody case for this reason, it can only be when the baby is 7-8 years old, and one more thing, if u visit the baby every month, give some food and money to your wife (specially through bank transaction) then in near future it will be helpfull to the maintenance case) and preliminary , you can file a petition under 97 crpc in SDM court to get back your wife with your baby, but if she allready filed an fir, then 97 will never be there.
