Dear sir On the ground of cruelty you may get divorce but as there are no strong grounds as such you may not get divorce in first court. Secondly you have to pay a minimum of 8-10lakhs as alimony to your wife. You may not get child custody till your daughter attains age of 5 years better go for mutual divorce.

Yes sir, you have option to take divorce from your wife by filing mutual consent petition or otherwise you required to file divorce petition. You have 2 year kid, the court will look in to the interest of the child in respect of custoday, education and taking care etc. If she wants maintenance from you, then you have to pay 1/3 amount from your salary for the wife only, for kid the court will decide what amount is required to pay it to kid. At this stage, the kid will be remained in the custody of mother. You better to convince her for mutual consent divorce with permanent alimony, then issue will be resolved otherwise you have option to file divorce petition and face the consequence with strong defence and contest before the Hon'ble court. kindly contact for further details.
