First motion Time in delhi (rohini court specifically)

28-Apr-2023 (In Divorce Law)
Q1. How much time does courts take in delhi to issue 1st motion after filing mutual consent divorse.Q2. Do I need to be physically present at the time of filing? I am currently out of India and have given power of attorney to my sister for all the legal matters regarding my marriage. So, can she file mutual divorce instead of me ? If yes, can she also attended the 1st & 2nd motion in my place, or I have to come back to india for the same.

you do not need to be physically present at the time of filing of the petition for divorce but when the court is hearing the petition for divorce you are required to be present as your statement recorded at the time when the divorce decree is being passed and no power of attorney can work in such cases

You need to come to attend the court proceedings because your signature will be required and your statement will be recorded. The gap of mutual divorce is maximum six months. That can also be reduced. For more legal assistance I am just a call away.

It takes only one date and maximum two dates which means a month or so for grant of the mutual divorce after filing of the petition. If you have given your POA to your sister then she can do it on your behalf.
