Filing of Divorce Case against my Wife

20-Feb-2023 (In Divorce Law)
I want to file a divorce against my wife. I’m Hindu by religion and reside in Rohini. My wife is harassing me and torturing me since the very beginning of our marriage. I was not interested for this alliance but was forced to do because of family pressure resulted in which I’m suffering. She’s not ready to go for a mutual divorce. Plus, I’m the only one who’s paying for the property even after a 50% participation from both ends. I’m hardly left with 6 thousand rupees for the entire month. I really need an immediate help.

You can file a divorce petition on certain grounds enunciated in section 13 of the Hindu Marriage Act. In case your spouse is not ready for the mutual consent divorce than you need to file a contested divorce. You should seek a detailed consultation and proceed ahead

You can always file for divorce from your side under cruelty basis. If the scope of mutual divorce is there then it’s better because the process of mutual divorce is less money & time waste and finishes within maximum of six months. For more legal assistance I am just a call away.

Please go ahead and file a divorce based on Cruelty. Your petition shall mention that you are paying for the property in its entirety and your financial situation. Divorce is not an open shut case. You shall build a strong case and expect 1-2 years for its conclusion. Usually, if you build a strong case you may encourage the other party to concede to a mutual divorce. Be extremely cautious as your petition shall build the foundation for all future averments. It's highly discouraged to add in new crucial information at a later stage.
