Both parties should attend the court.After filing mutual divorce , second motion time is 6 months. It is normal course . Some time you can ask for waive this cooling period after showing suitable ground for the same.

hi in a mutual consent divorce both the couple need to file a joint petition seeking dissolution of marriage and the judge will hear the parties and number the petition. this is called first motion. the judge will send the parties for reconciliation at district legal services authority if he is of opinion parties can be reconciled. then after 6 months , if he is convinced differences are irreconcilable then he may grant dissolution of marriage. in a mutual consent divorce, parties will have to settle terms of dissolution amongst themselves by drafting a memorandum of settlement in stamp paper and courts will not interfere with the terms. if the couple have children, then courts will interfere and decide terms of settlement to ensure well-being and welfare of child

sir you have to file a petition in court station that you and your spouse is not willing to stay together and mutually you have agreed to get separated and you are settteling it out of court and you do not wish to stay with each other
