File mutual divorce n get maintenance for me n daughter

When filing for mutual divorce can i file a maintenance case for me n my daughter. Need some guidance is mutual divorce done in court or out of court. Is it valid Also is it compulsory that i should file case in the city i got married

So in a mutual consent, you have to settle all claims including maintenance and have them reflected in the petition itself. If it’s claimed separately, it becomes a contested one. It’s not compulsory to file where you got married. You can file where you reside. The law permits women to file where they are living at that moment.

you cannot file support maintenance case in if you fail mutual divorce petition better you can file mutual divorce petition by way of amicable settlement if you file once then you cannot file you can file any residing places

The petition for divorce by mutual consent is filed by husband and wife together after settling issues between them including maintenance. Prior to filing the mutual consent divorce petition you and your husband have to prepare a memorandum of understanding to cover all the aspects of settlement so that aggrieved party will be able to take appropriate action against the erring party if necessary.

maintenance on month after month is totally waste. you had 10 years old daughter. you have to get one time payment to run the life. in the mutual agreement you have to agree for one time payment not for month and month payment
