Hello sir, as per your query I am would suggest you that if she is not contesting case under section 9 in Lucknow . They after getting judgment in section 9 you can definitely go for filing a divorce case based on the judgement under section 9 of hindu marriage act. dear client as per your query I can only suggest that if you have filed restitution of conjugal rgts and she is not appearing it would be better to finally make that petition in ur favour with findings of non appearance and then can file sec13 if both of you have children then as per discretion of the court u have to pay some amount if you evidence that she has filed the frivolous petition of 498a give a detailed reply to that and in section 125 too for future paid consultation please contact us with your relevant documents.

yes you can file for divorce to get away from all these cases filed against you also you should file a quashing against other cases. ur mediation must b going on what is the status for that . if you tell the status then I can suggest you better do about the whole thing because if she also wants to go for divorce and settlement out of court settlement but in any which case that settlement would be put in under 482 crpc in d high court
