File a divorce, claim alimony and share in property

28-Nov-2023 (In Divorce Law)
My father abandoned my mother, me and my sister 20+ years ago. My mother wants to file a divorce. We currently don't have my father's residential address. How would we move ahead with the filing of divorce? Is there any chance that my mother can claim for alimony ? Should I and my sister be filing a separate case to claim share in my father's property ? How much would a divorce case and property case cost? Religion : Hindu

Divorce can be fired for neglecting and abandoning for years but yeah notice has to be served in any of the ways provided in the law And if there are properties in his name you as children can claim your share if it is his ancestral property only.

Dear Madam I can understand yours agony. You can file Divorce and can claim marriage expenses etc. But he must have some properties to be attached. By issuing NEWS PAPER PUBLICATION. Your father will be placed ex parte and divorce decree will. be passed with alimony to your mother and marriage expenses to daughters.

What all properties your father has..??. Can you identify those properties..?? Divorce might not be easy now. Your mother and children all file for legal succession suit for your father's property. Cannot claim share in the life time of your father.

Firstly, you can make an enquiry in the last place where your mother and father resided together and then start tracing your fathera whereabouts from there. Yes, your mother can claim alimony and you and your sister also can claim a share in his property.
