Fastrack contested divorce - by reopening old HMOP or open new agains

Wife left after a year of marriage. My HMOP then filed got dismissed. Been living separate for 3 years now. I lost my hope in marriage. Should I reopen the old HMOP or file a fresh one - to get divorce sooner without waiting period.

better that you file a fresh petition for divorce as reopening of the old case dismissed will not only be difficult but also time consuming, file a fresh petition for divorce mentioning some new facts and cause of action and also mentioned the old case details and it's dismissal. i think the case the dismissed for non prosecution or default.

Hello, It is not clear from your query that under which provision and who you or your wife filled case under provision of. HMOP . And what is reason of dismissal of case. So you need to give proper information for right guidance.

Dear Sir, It is better to file new case without re-opening HMOP Case. You must set up new grounds for your new divorce case. You need not wait for any further period. See that your wife maybe placed ex-parte a new case and thus try to grab ex-parte divorce case otherwise it will run for years together.
