Hello,
I got married on 15-May-2020 and my wife left my house and went back to her paternal house after 3 months. She made our life hell as her mother kept on interfering and they demanded me to leave house and start living separately with my wife. Its been 8.5 months since she is at her paternal home and now they have filed a false FIR against my father, mother and myself (406, 498A, 323) in Mahila Thana. Need an expert advice if I should apply for an anticipatory bail and what should be my next steps to keep my family and myself secured from any arrest situation as well and harassment from police.
Hi you must apply for anticipatory bail , in such cases each state has some guidelines related to arrest of persons, you can take the advantage of the celebrity judgement “ Arnesh KUMAR”. Generally the judge grant interim bail and ask to settle the issues

hello client as i can see yr issue its totally seems to be trap of marriage fraud . marriage fraud means girl get married first in hurryness and then left the matrimonial home due to some illogicak reasons and after some time all cases if matrinoial cases along with criminal case gets filled . in your case tye things aree seems to ve bery much big trap by the girl side. i think we need to get first save our arrest as wella s we need to get cancelled rhe FIR process declearing it fraud. tht is the best way to sace you and your family.

If you have any apprehension of arrest then you should apply for anticipatory bail. Also get in touch with a good lawyer who can assist you to get out of these charges. However, there are various judgments of the Hon’ble Supreme Court for not arresting the accused under these charges as mentioned in your question because nowadays most of the times these are falsely implicated cases in vendetta.
