False Compliant by Wife and police harassment's

14-Apr-2023 (In Divorce Law)
I got married 6 months back. She had totally stayed for 2 months in my home. And after that, she left for her mother's home in the month of Jan 2022 after fighting. We tried to talk to her parents, but they also shouted and were not in the mood to listen to what we said. I am staying in Chennai with my parents and the Girl is from Nellore, Andhra Pradesh state. Now, in April, all of a sudden I got a call to mobile from SI of their police station, he informed me that my Wife has given a complaint on me and mother. He is not revealing what complaint but he asked me to come to their hometown police station along with my mother. I told them that I am in hospital for Father's medical checkup due to poor health condition and I would require one week time to travel there (Nellore, Andhra Pradesh). But the SI is not giving me time and asking me to come in the Next Day. What Should I do? Is the police in right to call me to the Police station without any notice? Pls, advise.

Your case is one of the routine ones. As per law the police have to issue notice to you with the date and time for your appearance. If the Nellore police contact you again then you ask them to send proper notice. Usually police complaint must be filed where the offense had taken place.

the police had the authority to call you without any notices under crpc. the police must give time to you for your appearance. the marriage spell is very short period. no one could understand anyone. if you need then you can file divorce. otherwise file rcr. because your issue involved sensitivity
