The mutual consent divorce requires both parties to agree and appear in front of the Court. If your wife is not cooperating with you for separation, you cannot force her for mutual divorce but you have the right to file a contested divorce on valid legal grounds such as separation for more than 1 year. If you have already paid 8 lakhs out of the 14 lacs demanded by them. Keep all the proofs of receipts, Bank transfers and written agreements if there. Do not pay any money without proper legal documentation. You should pay all the payments should be bank transfer or check for your proofs. immediately Consult a lawyer to file a petition in family court for contested divorceD based on desertion or cruelty. o not pay the balance amount unless your divorce is legally initiated and the settlement is recorded in the Court .

Since the mutual consent divorce didn’t materialize and she has filed a maintenance case, you can contest it by presenting proof of the ₹8 lakh already paid and the written understanding on stamp paper. However, such informal agreements may not be binding unless recorded in court. You may file a contested divorce petition and seek proper legal remedy against unreasonable monetary demands.
