Fake Complaint registered by wife at CAW cell

I got Married in 2021 and my wife left my home in the month of March 2022 for the sake of performing Holi Rituals. After that, she is not willingly to return at my home. she made her stand clear that she does not want to stay with me anymore and want separation or divorce. The day she left my home, she took all her jewelry, my jewelry and few of my mother and father. I had already filed a complaint or information about this to the police. Now last week she had lodged a fake complaint against me.

How complaint filed by wife is fake? complaint can be false but cannot be fake. Since wife has filed complaint do police will accordingly investigate the matter and if police call you then join the investigation and put your version. Take guidance of a competent lawyer.

In your case you need to first of all approach the court and file a petition under section 9 HMA for calling back your wife in your matrimonial life. It will serve as a defence from your side in case your wife indulge you in DV & maintenance case. For more legal assistance I am just a call away.

My suggestion to you is to file a case for restitution of conjugal rights under section 9 of Hindu Marriage Act for bringing her back to matrimonial home and simultaneously file a petition for quashing of FIR in the high court. for more details you may consult me

If there is a complaint against you and it is lodged by your wife with any of the departments concerned as mentioned by you, then this must be contested and should be responded in time. If it is a fake complaint, then she will face the repercussions of it and will be prosecuted for the fake complaints and misinformation.
