Facing 498A, Please help, NRI Here,
09-Jan-2023 (In Divorce Law)
I am Indian by birth Now a Naturalized Citizen of China since 2021 January.
There is pending amount of 7 crore maintenance as per Crpc 125 back in India .
I have not participated in any maintenance cases in India.
My Indian Passport was canceled in 2020 for not participating in 498A and non payment of maintenance and I was forced to apply for Naturalization in China so that I do not not become illegal here.
I am holding Passport of PRC ( People's Republic of China) .
I need to see my parents, my elder sister , her husband secretly, visit India secretly and come back to China without getting arrested and without the knowledge of Indian Judiciary.
Can anyone advice me about the procedure to enter and exit India without getting arrested?
your issue involves various question of facts, you can challenge the various orders passed by the judge before higher orders and you can get directions to restore passport validity for in force.
498A is purely disputes between family member, it's cannot be used as tool to violate the rights of freedom and movement , under constitution and various highcourta and supreme court held same.
don't try alternatives to visit India just proceed legally and consult advocate and explain each and every incident for more information.

To suitably advice, I’d need a few more details.
Case antecedents, status and the actions taken there after.
At the outset, and with the details provided, you may obtain an (anticipatory) bail if there are no pending criminal charges against you already and challenge the order imposing 7 cr maintenance.
